106. Lance is the Director of the Harristown Bicycle Club, a nonprofit, 501(c)(3) tax exempt organization. Lance is dismayed to discover that the winner of the Club’s annual professional championship has tested positive for EPO. He meets with the alleged violator, and negotiates an agreement whereby the winner agrees to return the prize money in the form of a donation to the club, not participate in any future events sponsored by the Club, but is not required to admit any wrongdoing. The agreement requires that both parties keep the agreement entirely secret from the public. A reporter calls Lance and starts asking questions about whether there was any evidence that the winner had tested positive for EPO or other performance enhancing drugs. Lance responds with a flat “that is a total fabrication.”
